Indiana Drug Defense Attorneys

The charge doesn’t wait, and neither should you.

Why Indiana Drug Defense Lawyers Are Relevant to Your Case

A drug charge in Indiana hits fast. Your job, your name, your housing, and your freedom can all take a hit before you ever have your day in court. You may already feel like the State has decided what happened. It has not. The State still has to prove its case.

If you are looking for Indiana drug defense attorneys, you need a defense that starts with the record. At Custom Law, we look at the stop that led to the search, the search itself, the evidence, the police report, the lab work, and every step the State took to build the case.

Drug charges can range from possession to dealing and other serious felony allegations. The consequences can include jail, fines, a criminal record, and collateral consequences that follow you long after the case ends.

You do not need moral judgment. You need someone who will look at what happened, tell you straight where you stand, and make the State prove every point.

What a Drug Charge Does to Your Life in Indiana

A drug charge does not wait for a conviction to cause damage. Your name may appear in public records. Your employer may find out. Your family may find out before you have had a chance to explain what happened.

A charge can put your job, housing, professional license, and reputation under pressure. Meanwhile, the State is already building its case.

That is why waiting is dangerous.

Indiana drug cases can move quickly through the courts. The State may rely on the stop, the search, statements, physical evidence, laboratory results, or other evidence gathered during the investigation. If nobody takes a hard look at how that evidence was obtained, problems in the case can go unchallenged.

At Custom Law, our Indiana drug defense attorneys look at how the case was built.

Was the stop lawful? Was there a legal basis for the search? Did officers follow the required procedures? Does the evidence actually establish possession or another charged offense? Was the evidence properly handled and tested?

These questions matter.

Our criminal defense work covers drug charges in Indiana courts. We do not tell you how your case ends. We tell you where the record deserves scrutiny and what the State still has to prove.

Why Custom Law Fights Indiana Drug Cases

Custom Law brings prosecutorial experience to drug defense. Both founding partners prosecuted cases in Indiana before moving to defense. They know how the State builds cases because they have been on that side of the courtroom.

That experience now informs how we examine the State’s case against you.

Both Partners Were Prosecutors in Indiana Courts

Robert Summerfield and Nicholas Dandurand each served as prosecutors in Hamilton County before founding Custom Law. They understand how prosecutors evaluate evidence, develop charges, and prepare cases for court.

That perspective matters when we start pulling apart the record.

We look for the issues that can get missed when everyone accepts the police report at face value. We examine the evidence, the procedure, and the State’s theory instead of assuming the case is as strong as the charging document makes it appear.

Former Deputy Prosecutor on Your Side

Nicholas Dandurand served as a deputy prosecutor in Hamilton County. He has seen drug cases from the prosecution side, including how evidence is reviewed and how charges move through the system.

That experience gives him a practical understanding of what the State may rely on and where the defense needs to push back.

Trial Preparation Starts on Day One

Every case at Custom Law is prepared with trial in mind from the beginning.

That does not mean every case goes to trial. It means we do not wait until trial is scheduled to examine the evidence, develop the defense, and identify weaknesses in the State’s case.

If the case can be resolved without trial, preparation still matters. You should know what the State can prove before you decide whether to accept its proposed resolution.

Hamilton County Home Court Knowledge

Custom Law is based in Noblesville and serves clients throughout Hamilton County and Central Indiana.

Local knowledge matters. Drug cases move through specific courts, before specific judges and prosecutors, under local procedures. Our attorneys have spent years working in the Hamilton County court system.

We also serve clients in Carmel, Fishers, Westfield, and communities throughout Central Indiana.

Boutique Firm, Personal Attention

Custom Law is a small firm by design. You work directly with an attorney who knows your case.

Your file does not disappear into a large system where you have to explain the same story repeatedly. When you have a question, you can speak with someone who understands what is happening in your case.

That access matters when the charge is already affecting your life.

Here is what that means in practice:

  • Direct attorney contact throughout your case
  • Prosecutorial insight from attorneys who have worked on both sides
  • Trial preparation from the beginning
  • Local Hamilton County presence with reach across Central Indiana
  • Personal attention so your case is handled as your case, not a template

Drug charges move fast in Indiana. The State is already building its case.

We believe your defense should be doing the same.

What Happens After You Call Us

The first thing we need from you is the truth. Tell us what happened, including the parts you think hurt your case. We do not moralize. We need the facts because that is how we find the issues worth fighting.

Step 1: Case Review

Your first step is a confidential case review. You walk us through what happened, the charge you are facing, and the circumstances surrounding the stop, search, or arrest.

We listen. We ask questions. We identify what needs to be investigated and what records we need to see.

Step 2: Document and Evidence Review

We review the available records and evidence, which may include police reports, arrest records, laboratory results, photographs, body-camera footage, dashcam footage, and other discovery.

We look at the entire record, not just the evidence that makes the State’s case look strong.

Was the stop lawful? Was the search supported by a warrant, consent, probable cause, or another recognized exception? Was the evidence properly collected and preserved? Does the laboratory evidence support what the State claims?

According to Indiana’s search-and-seizure rules, they can give the defense grounds to challenge evidence when law enforcement did not follow the law. Depending on the circumstances, that may include a motion to suppress evidence.

Step 3: Build the Defense Strategy

Once we know what the record says, we build the defense around the facts.

Some cases turn on an unlawful stop. Others involve questions about the search, possession, identification, statements, laboratory testing, or the handling of physical evidence.

If the State’s evidence has a weakness, we address it.

If a negotiated resolution makes sense based on the facts, we approach that negotiation prepared to explain exactly where the State’s case stands.

Step 4: Court Appearances and Motions

We handle the court process and appear with you when required.

Where the facts and law support it, we file motions challenging evidence or other parts of the prosecution’s case. A suppression motion may ask the court to exclude evidence obtained through an unlawful search or seizure.

The goal is not to file motions for the sake of filing them. The goal is to challenge evidence when there is a legitimate legal basis to do so.

Step 5: Resolution

Drug cases can be resolved in different ways. Depending on the facts, the case may be dismissed, reduced, resolved through a plea agreement, or taken to trial.

We prepare every case with trial in mind from day one. That preparation gives us a clear understanding of the evidence and the issues before decisions are made about resolution.

We do not promise a particular result. We tell you straight what the record shows and what options you have.

Timeline

A misdemeanor drug case may move within a matter of months. A more serious felony case can take longer, particularly when there are substantial discovery materials, contested evidence, or pretrial motions.

The timeline depends on the court, the charge, the evidence, and the issues in the case.

We keep you informed about what is happening, what comes next, and what decisions need to be made.

Questions About Indiana Drug Charges

Can I be charged with a felony for possessing a small amount of drugs in Indiana?

It depends on the substance, amount, prior convictions, and other circumstances. Indiana law makes some controlled-substance possession a Class A misdemeanor, but allows an enhancing circumstance to elevate certain possession offenses to a Level 6 felony. Other controlled substances, including methamphetamine, have their own statutory classifications and enhancements.

What happens if the police found drugs in a car I was riding in, but did not own?

You can still face a possession allegation, including under a constructive-possession theory. But being present in a vehicle does not by itself answer whether the State can prove possession. The location of the drugs, your access to them, your statements, and the other evidence all matter.

Will a drug conviction affect my driver’s license in Indiana?

Certain drug convictions can affect driving privileges under Indiana law, even when the offense did not involve driving. The specific consequences depend on the offense and circumstances. If a drug charge could affect your license, that issue should be addressed as part of the case rather than treated as an afterthought.

How long does a drug case typically take to resolve in Indiana courts?

There is no single timeline. A misdemeanor may resolve within months, while a felony case involving extensive evidence, contested motions, or a trial can take considerably longer. The court schedule and the issues in the case will affect how quickly it moves.

Can a drug charge or conviction be expunged from my Indiana record?

Indiana law allows expungement for certain arrests, convictions, and felony records when statutory requirements are met. The waiting period and eligibility requirements depend on the type of record and conviction. For example, Indiana’s current expungement statutes provide different timelines for misdemeanors, Level 6 felonies reduced to misdemeanors, and other felony convictions.
